Article 1. Acceptance of the Terms

By accessing or using the Tu Salón platform, or by registering as a user, you agree to be bound by these Terms and Conditions of Use (the "Terms"). If you do not agree with any part of these Terms, you must not use the Service.

Acceptance is formalised by the mandatory checkbox in the registration form, prior to account creation. Continued use of the Service after notice of changes to these Terms constitutes acceptance of those changes.

Article 2. Identification of the Service Provider

The Tu Salón Service is provided by:

The Service is offered to users located in countries of Latin America and the Caribbean, subject to the availability indicated in the registration form.

Article 3. Description of the Service

Tu Salón is a comprehensive management platform for beauty businesses — including hair salons, barbershops, nail salons and beauty studios — accessible via the web, allowing management of: calendar and appointment booking, client management and history, services and products, sales and payments, cash registers by payment method, suppliers and running accounts, automatic reminders, business reports and metrics, and user and subscription management.

The Service is provided on a Software as a Service (SaaS) basis, cloud-hosted, requiring no local installation by the user.

Article 4. Registration and User Account

Using the Service requires registration with a valid email address and a personal password. The user undertakes to: provide truthful, accurate, current and complete information; keep their credentials confidential; notify the provider immediately of any unauthorised use of their account; and accept full responsibility for all activity occurring under their account.

Creating accounts with false data, duplicating existing accounts, or registering using a third party's data without their express consent is expressly prohibited.

Article 5. Subscription Plan, Price and Billing

Tu Salón offers a single subscription plan that includes all functionality available on the platform at the time of subscription.

Price: USD 9.90 (nine United States dollars and ninety cents) per month. The price is denominated in United States dollars. The payment gateway may display the amount converted to local currency at the time of payment, depending on the user's account configuration; the exact amount is shown before the transaction is confirmed. The user's country does not change the price.

5.1 Trial period

On registration, each new account receives a trial period of 1 (one) calendar month, free of charge. Activating the trial period requires entering a valid payment method (credit or debit card). No charge is made during the trial period. If the trial month ends without prior cancellation, the paid subscription begins automatically.

The trial period is granted only on a user's first subscription. An account that has previously been a customer and subscribes again does not receive a new trial period.

5.2 Billing and payment

Subscription payment is processed through the Stripe payment gateway, which processes payments in various countries and currencies. The subscription renews automatically on a monthly basis. No annual billing plan is offered.

The user may cancel automatic renewal at any time from their account settings, effective from the next billing period.

Tu Salón does not directly store credit or debit card data. Payment processing is carried out by Stripe under its own security and privacy policies.

5.3 Price changes

The provider reserves the right to change the subscription price, giving the user prior notice at their registered email address at least 14 (fourteen) days in advance. A user who does not accept the new price may cancel the subscription before it takes effect, in accordance with Article 12.

5.4 Failed payment

If a monthly charge cannot be processed, the account enters a 7 (seven) day grace period during which the Service remains fully available and the user receives email notices. If payment has not been resolved by the end of that period, access to the Service is suspended. Suspension does not delete account data: access is restored once payment is resolved.

Article 6. Permitted Use and Restrictions

The user undertakes to use the Service only for lawful purposes and in accordance with these Terms. The following are expressly prohibited: using the Service for illegal or fraudulent activity; attempting to access third-party accounts or systems without authorisation; reverse engineering or attempting to obtain the source code; reselling or sublicensing access without written authorisation; uploading malicious content; overloading the technical infrastructure; and using robots or scrapers without express authorisation.

Article 7. Intellectual Property

The Service, its source code, design, interfaces, logos, the Tu Salón brand and all proprietary platform content are the exclusive property of the Service provider or its licensors, and are protected by applicable and international intellectual property law.

Data entered by the user into the platform (clients, services, transactions, suppliers, etc.) is the property of the user. The provider does not assign, sell or transfer such data to third parties, except in the cases set out in the Privacy Policy.

Article 8. Privacy and Personal Data Protection

The processing of the user's personal data, and of their clients' data entered into the platform, is governed by the Tu Salón Privacy Policy, which forms an integral part of these Terms and must be read together with them.

The provider seeks to align its data processing with the personal data protection legislation in force in the user's country of residence.

Article 9. Service Availability and Maintenance

The provider will endeavour to keep the Service continuously available, without guaranteeing uninterrupted availability. The Service may be temporarily affected by scheduled maintenance, failures in third-party hosting or connectivity infrastructure, force majeure events, or unforeseen technical circumstances beyond the provider's reasonable control.

The Service requires an internet connection and does not offer offline operation.

Article 10. Limitation of Liability

⚠ For the lawyer — This clause must be reviewed against the consumer protection legislation of each country where it is published (for example, unfair terms in adhesion contracts). Note retained from the original draft.

To the maximum extent permitted by applicable law, the provider shall not be liable for indirect, incidental or consequential damages arising from the use of or inability to use the Service; loss of data, profits or clients, save in cases of wilful misconduct or gross negligence; interruptions not directly attributable to the provider; or acts of third-party providers of infrastructure, payment or other integrated services.

The provider's total aggregate liability to the user shall not exceed the amount actually paid by the user over the last 3 (three) months of subscription. This limitation does not apply in cases of the provider's wilful misconduct or gross negligence.

Article 11. Changes to the Service and to the Terms

The provider reserves the right to modify, suspend or discontinue the Service, and to update these Terms, giving the user prior notice by registered email and/or notice within the platform, at least 14 (fourteen) days in advance.

Article 12. Cancellation and Termination

12.1 Cancellation by the user. The user may cancel their subscription at any time from their account settings, without needing to contact the provider. The account remains active until the end of the period already paid for, with no pro-rata refunds for unused time. While the paid period remains in force, the subscription can be reactivated from the same place.

12.2 Termination by the provider. The provider may suspend or terminate the access of a user who breaches these Terms.

12.3 Data export. The user may download their account information at any time from the Profile section. Following cancellation or expiry without renewal, the user has a period of 7 (seven) days to export their information before the data is deleted in accordance with Article 8 of the Privacy Policy.

[REVIEW] The feature this clause depends on now exists (Profile → "Tus datos" → "Pedir descarga"), and was verified to remain reachable once the subscription has lapsed or been cancelled. It is for the reviewer to decide whether the 7-day window should also be stated as a retention period in Article 8 of the Policy.

Article 13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States of America, without prejudice to any mandatory consumer protection rules that may apply in the user's country of residence. For the resolution of disputes, the parties submit to the jurisdiction of the competent courts of the State of Wyoming, United States of America.

[REVIEW] VFG LLC is incorporated in Wyoming through a registered agent, while the address associated with its tax identifier is in New York. Wyoming was taken as the legal domicile as the state of incorporation. The lawyer should confirm: (a) that Wyoming is the correct choice over New York, and (b) the practical effect of a United States jurisdiction clause against consumers domiciled in Latin America, given that in several countries consumer rules are mandatory and may displace the chosen forum.

Article 14. General Provisions

If any provision of these Terms is held invalid by a competent court, that provision shall be modified to the minimum extent necessary to make it valid, and the remainder of the Terms shall continue in full force.
